FitHive Terms of Service

This Agreement is entered into between FitHive Studio (“the Studio”) and the individual named in the membership registration (“the Member”). By purchasing a membership, class pack, or attending any session, you agree to the following terms and conditions.


1. MEMBERSHIP MANAGEMENT & APP USAGE

FitHive operates as a digital-first boutique studio to ensure operational efficiency and a seamless member experience.

  • MOBILE APP: All members must download the FitHive mobile app from the iOS or Play Store. This app is the exclusive platform for managing your membership, including initial registration, booking classes, pausing (freezing), and canceling your plan.
  • CHECK-IN POLICY: The app serves as your digital key. You are required to check in at the studio front desk via the app’s embedded barcode/QR code every time you enter the studio to work out.
  • COMMUNICATION: The app is the primary means of communication between FitHive and its members for schedule changes, studio news, and account alerts.

2. BOUTIQUE STUDIO POLICIES

As a boutique space, our classes are high-demand and operate on a strictly scheduled basis to maintain the quality of the experience.

  • CLASS BOOKINGS: Members may book their spots up to two (2) days in advance via the FitHive mobile app.
  • ARRIVAL & LATE ENTRY: For your safety and to prevent disruption, members should arrive at least 10 minutes before their class. Once the studio doors are closed and the lights are dimmed, entry is strictly prohibited. Late arrivals will be treated as a “No-Show.”
  • LATE CANCELLATION & NO-SHOWS: Cancellations must be made via the app at least one (1) hour before the scheduled start time. Failure to do so will result in:
    • Standard Members & Class Packs: Forfeiture of one (1) class credit.
    • Unlimited Members: A late-cancel or no-show fee of ₦7,500.
  • WAITLIST PROTOCOL: If a class is full, you may join the waitlist. If a spot opens, the automated system will notify you via the app/email and you can book the class. It is your responsibility to monitor your status; if you are moved into a spot and cannot attend, you must cancel within the 1-hour window to avoid penalties.

3. MEMBERSHIP & FINANCIALS

  • MEMBERSHIP TYPES:
    • Standard: Includes up to 30 classes per month.
    • Unlimited: Includes unlimited regular classes and access to “Special Classes.”
    • Plans: Both tiers are available as Monthly, Quarterly, Bi-Annual, or Annual memberships.
    • Couples Packages: Discounted rates for two individuals; both accounts must remain active to maintain the discount.
  • FEES & ENTITLEMENTS: Your fees entitle you to the specific privileges of your plan. By signing this contract, you agree to pay all membership fees and on-account charges regardless of whether you utilize the services, unless you cancel before the automated billing period.
  • ANNUAL DUES: A recurring annual payment is required for gym enhancements, including facility renovations, equipment replacement, and repairs.
  • EXPIRATION OF CREDITS: Unused class credits do not “roll over” to the next month. All monthly credits expire at the end of the billing cycle.
  • PAUSING (FREEZE) POLICY: Pausing is only available for Quarterly, Bi-Annual, and Annual memberships.
    • Pause Entitlements:
      • Quarterly: Entitled to one (1) pause per cycle.
      • Bi-Annual: Entitled to two (2) pauses per cycle.
      • Annual: Entitled to Three (3) pauses per cycle.
    • Duration: Each pause must be a minimum of 10 days and a maximum of 20 days per calendar year in total.
    • Notice: You must provide at least three (3) days’ notice via the message prior to the requested start date of the pause.
  • GUEST PASSES: Guest Passes are available only to members on Quarterly, Bi-Annual, and Annual plans and may only be used based on class space availability.
    • Guests must register at the front desk and provide valid ID.
    • You are responsible for your guest’s behavior and must ensure they abide by all studio rules and the “Assumption of Risk” clause.

4. BILLING & AUTOMATIC RENEWAL

  • TRANSACTION POLICY: Your membership is a rolling contract. Your card on file will be charged automatically at the beginning of each cycle on your “payment day.”
  • PAYMENT GATEWAY: All digital transactions and direct debits are processed through our payment partner, Paystack. This payment partner can be changed without notice.
  • FAILED DEBITS: In the event of a failed debit, we will attempt to bill your card for five (5) or more consecutive days. Should the debit still fail, the outstanding debt will be carried over for full recovery, and your studio access may be restricted.
  • CANCELLATION/OPT-OUT: To stop automatic billing, you must cancel your membership via Paystack no less than three (3) business days before your next billing date.
  • PRICE ADJUSTMENTS: FitHive reserves the right to increase fees at any time. You will be given 30 days’ notice via email prior to any changes taking effect.

5. SAFETY & PHYSICAL READINESS

  • STUDIO-SPECIFIC SAFETY:
    • Cycling: Proper shoe clipping is essential for safety. If you are unfamiliar with bike setup or cleat engagement, you must arrive early and ask an instructor for assistance before the lights dim.
    • Strength: Members must handle weights and kettlebells with care. Slamming or dropping weights is strictly prohibited to prevent injury and floor damage.
    • Dance, Yoga etc: Appropriate studio-specific footwear must be worn at all times to prevent ankle injury and maintain the integrity of the dance floor.
  • HEALTH STATUS: You certify that you are aware of your health status and have no medical condition or impairment that would prevent you from participating in high-intensity physical conditioning. You acknowledge that you use FitHive facilities at your own risk.
  • PREGNANCY & SPECIAL CONDITIONS: For your safety, members are strongly encouraged to notify instructors of pregnancy or any physical limitations/injuries before class starts so that proper modifications can be provided.

6. CODE OF CONDUCT (“THE VIBE”)

FitHive is a focused community environment designed for an immersive fitness experience. By entering the studio, you agree to the following standards:

  • STUDIO ETIQUETTE: The use of mobile phones during class is strictly prohibited. Please keep talking to a minimum while the instructor is providing guidance.
  • HYGIENE & ATTIRE: Clean workout attire and towels are essential. While FitHive ensures all equipment is professionally cleaned and sanitized before and after classes, members are required to wipe down their bikes, mats, and weights after every use.
  • PROHIBITED ITEMS:
    • Firearms or weapons of any kind are strictly prohibited.
    • Smoking (including e-cigarettes/vaping) is not permitted anywhere on the premises.
    • Alcohol or illegal drugs are strictly forbidden.
  • FLOOR POLICY: With the exception of water bottles and sports drinks, no food, outside drinks, or gym bags are allowed on the training floor. Please keep the workout area clear of tripping hazards.
  • FACILITY CARE: You will be held liable for the cost of any damages caused by you, your dependents, or your guests to the studio, equipment, or fixtures.
  • SHOWER ETIQUETTE: To ensure privacy and safety, only one individual is permitted in a shower cubicle at a time.
  • ZERO TOLERANCE: We maintain a safe, inclusive, and positive space. Harassment, discrimination, foul language, or aggressive behavior toward staff or other members will result in immediate membership termination without a refund.

7. USE OF LOCKERS & PERSONAL BELONGINGS

  • STORAGE: Lockers are provided in the changing rooms to store your gear while you train. FitHive does not guarantee that the use of a locker will prevent theft or damage to your property.
  • LIABILITY: We do not accept responsibility for the loss or theft of money or damage to the personal property of members or guests, whether locked in a locker or otherwise. We recommend that your personal insurance policy covers your items.
  • UNATTENDED ITEMS: Do not leave belongings unattended in the changing rooms or any other part of the studio. Please report any lost items to the front desk immediately.
  • LOCKER ACCESS: Management reserves the right to open a locker (by force if necessary) if there are reasonable grounds to suspect it is being used for storage of items other than clothing or permissible personal belongings.
  • OVERNIGHT POLICY: No locker should be left occupied overnight. Any belongings left overnight will be removed. If not claimed within five (5) days, items will be donated to charity.

8. LEGAL PROTECTIONS

  • WAIVER & RELEASE OF LIABILITY: You hereby release FitHive, its directors, employees, and contractors from any liability, claims, or damages arising from injury or death resulting from your use of the gym facilities, equipment, or participation in any program.
  • ASSUMPTION OF RISK: You agree that your use of the facilities is at your own risk. FitHive shall not be responsible for any theft, loss, or damage to personal property (including phones, bags, or vehicles) while on the premises.
  • PHOTO & MEDIA RELEASE: You acknowledge that FitHive frequently films or photographs classes for marketing and social media purposes. By attending a class, you consent to FitHive using your image, likeness, and voice in any promotional materials without further compensation.

9. ADMINISTRATIVE & DISPUTE RESOLUTION

  • GOVERNING LAW: These Terms and Conditions shall be governed by and construed under the Laws of the Federal Republic of Nigeria.
  • DISPUTE RESOLUTION: The Parties shall endeavor to resolve all disputes through mutual consultation. Any dispute which cannot be resolved within 30 days shall be referred to and finally settled by arbitration at the Abuja Multi-Door Court House (AMDC) before a single arbitrator.

NO WAIVER: FitHive’s failure to enforce any term of this agreement at any time shall not be construed as a waiver of the right to enforce such terms in the future.These Rules may be revoked, altered or added to from time to time by the Company, without prior notification to Members. Any such variations will be updated on the Studio Rules on our website.
